At Latii, we take your privacy seriously. This Privacy Policy applies to information we may collect or process about you as a result of your use of our website www.latii.com (our “Website”), our cloud-based supply chain platform (the “Platform”), and any other services we may provide to you through this Website (collectively, the “Services”). Please read this Privacy Policy carefully. By using or accessing our Website or any of our other Services in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby consent that we will collect, use and share your information as described in this Privacy Policy.
Remember that your use of Latii's Services is at all times subject to our Terms of Use , which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms.

What This Privacy Policy Covers

Latii is in the business of offering, selling and supplying residential and commercial construction supplies and materials using our Platform. This Privacy Policy covers how we treat Personal Data that we gather when you access or use our Services. Latii’s API products (if any), on the other hand, when licensed to commercial partners for integrations, are intended solely as business-to-business offerings and this Privacy Policy does not apply to our data use practices in connection with those products, which are instead covered under other policies and agreements for integrations. This Privacy Policy does not cover how we treat Personal Data that we process as a processor or service provider. Please check with your employer on their privacy policies and data sharing policies to better understand your rights. In this document, “Personal Data” means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws, rules or regulations. This Privacy Policy, further, does not cover the practices of companies we don’t own or control or people we don’t manage.

              We will not collect additional categories of Personal Data or use the Personal Data we collected for materially different, unrelated or incompatible purposes without providing you notice.

                      Business Transfers

                      All of your Personal Data that we collect may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part). Should one of these events occur, we will make reasonable efforts to notify you before your information becomes subject to different privacy and security policies and practices.

                      Data that is Not Personal Data

                      We may create aggregated, de-identified or anonymized data from the Personal Data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Services and promote our business, provided that we will not share such data in a manner that could identify you.

                      Tracking Tools and Opt-Out

                      The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data– usually text files – placed on your computer, tablet, phone or similar device when you use that device to access our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s). Please note that because of our use of Cookies, the Services do not support “Do Not Track” requests sent from a browser at this time.

                      Data Security and Retention

                      We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure.

                      We retain Personal Data about you for as long as you have an open account with us or as otherwise necessary to provide you with our Services. In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.

                      Personal Data of Children

                      As noted in the Terms, we do not knowingly collect or solicit Personal Data about children under 13 years of age; if you are a child under the age of 13, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 13 years of age, we will delete that information as quickly as possible.                       PRIVACY RIGHTS:

                      You may have certain additional rights subject to applicable laws (including, without limitation, the privacy laws under California, Colorado, Connecticut, Utah and Virginia), including the rights set forth below.

                      We will take reasonable steps to allow you to access, review, update, rectify, or delete any personal data we hold about you. You have the following data protection rights:

                      • Right to Rectification.  The right to erase or rectify inaccurate or incomplete data.
                      • Right to Erasure.  The right to obtain the deletion and erasure of your personal data in certain circumstances.

                      Additionally, subject to applicable law, you may receive, in a structured, commonly used and machine-readable format, certain of your personal information that you have provided to us. Subject to applicable law, you may have the right to have this information transmitted to another company, where it is technically feasible.

                      California Resident Rights

                      This Supplemental California Privacy Notice only applies to our processing of personal information that is subject to the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA”).                       As described above, please note that we may also disclose personal information to our affiliates and third-party service providers, in connection with corporate restructuring, to comply with law, or for compliance, fraud prevention and safety purposes.

                      We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to comply with applicable legal, tax or accounting requirements, to enforce our agreements or comply with our legal obligations). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing, until deletion is possible. When processing customer content on behalf of our customers, we will retain customer content for as long as our customer instructs us to and/or as required by applicable law.

                      Except as excluded above, the CCPA grants California residents the following rights:

                      • Information. You can request information about how we have collected, used and shared your personal information during the past 12 months. We have made this information available to California residents without having to request it by including it in this Privacy Policy, in the chart above. 
                      • Access. You can request a copy of the personal information that we maintain about you.  You can submit such request to us at support@latii.com.
                      • Deletion. You can ask us to delete the personal information that we collected or maintain about you. You can submit such request to us at support@latii.com.

                      Please note that the CCPA limits these rights by, for example, prohibiting us from providing certain sensitive information in response to an access request and limiting the circumstances in which we must comply with a deletion request.  If we deny your request, we will communicate our decision to you. To the extent we collect sensitive personal information, we do so only to determine whether we are able to provide our services or as part of our ongoing services packages.  The CPRA allows you to limit the use or disclosure of sensitive personal information beyond what is reasonable and proportionate to the requested goods and services provided by Latii, which you may do by contacting us to make such request. In addition, to the extent applicable under the CPRA: (i) you have the right to opt out of our sale or sharing of personal information; and (ii) if we sell any of your personal information, you have the right, at any time, to tell us not to sell your personal information.

                      To the extent that the CPRA is applicable to you in respect of your accessing our website, or Platform or using any of our other Services, you have the right to request that we rectify inaccurate information about you. By visiting your account settings or otherwise contacting us, you can correct and change certain personal information associated with your account.

                      You are entitled to exercise the rights described above free from discrimination, and to ask someone else to exercise your privacy rights for you as your authorized agent.

                      The CCPA requires us to verify the identity of the individual submitting a request to access or delete or rectify personal information (or written permission or other proof that you have appointed an agent to serve on your behalf) before providing a substantive response to the request.

                      Nevada Resident Rights

                      If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at support@latii.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. For clarity, Latii does not sell personal data.

                       

                      Changes to This Privacy Policy

                      We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time, but we will alert you to any such changes by placing a notice on the Latii website, by sending you an email and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect is subject to the Privacy Policy in effect at the time such information is collected. You are expected to check this webpage from time to time so you are aware of any changes, as they are binding on you.
